Court Grants Mother Custody Of 4 Children In Kwara

The court stated that the father, however, had unrestricted access to their children and should be responsible for their feeding, school fees, medicals and general welfare.

An Area Court sitting in Centre-Igboro in Ilorin, Kwara State, has granted a woman, Olomu Ajibola, custody of her four children to enable her care for them.

The presiding judge, Hammad Ajumonbi, while ruling on the matter, said nobody had the right to deny a mother access to her children, even if the father was legally granted custody.

The husband, Mr Ajibola, had on April 16, applied for divorce and custody of their children over a disagreement with the wife, which she consented to.

But she alleged she had not been allowed to see their children since then.

Magistrate Ajumonbi, therefore, granted custody of the four children to their mother, since the father did not have any evidence to prove otherwise.

The court stated that the father, however, had unrestricted access to their children and should be responsible for their feeding, school fees, medicals and general welfare.

“The parents should never take the children out of the jurisdiction of the court, except on mutual agreement of the parents,” the judge ruled.

He, however, said that the mother shall cease to have custody the moment she remarries.
