Court Stops PDP From Removing Samuel Anyanwu As National Secretary

Justice Inyang Ekwo, on Thursday, granted the ex-parte request filed by Joshua Musa, SAN, in a ruling.

 
The Peoples Democratic Party has been ordered not to remove Samuel Anyanwu as the party's National Secretary.
 
The order was given by a Federal High Court in Abuja.
 
The court ordered the Peoples Democratic Party (PDP) not to remove Senator Samuel Anyanwu as national secretary of the party until the substantive matter is heard and decided.
 
Justice Inyang Ekwo, on Thursday, granted the ex-parte request filed by Joshua Musa, SAN, in a ruling.
 
He then adjourned the case until December 4 for a hearing on the application on notice.
 
Two party members, Geoffrey Ihentuge and Apollo’s Godspower, had sued the PDP, Umar Aliyu Damagun (acting National Chairman), and the National Executive Committee (NEC) as the first to third defendants.
 
The National Working Committee (NWC) and the Independent National Electoral Commission (INEC) are the fourth and fifth defendants, respectively.
 
The motion was filed in accordance with Order 26, Rules 2 and 6 of the FHC (Civil Procedure) Rules, 2019, as well as the court’s inherent authority.
 
The plaintiffs requested an interim injunction to prevent the first, second, third, and fourth defendants from carrying out the threat to remove the national secretary (Anyanwu).
 
This, he claims, is a violation of Article 47 (1) of the PDP Constitution (as revised in 2017) awaiting the hearing and determination of the move on notice.
