The court ordered that the defendant be remanded in prison custody pending receipt of the DPP’s advice.
A 27-year-old man identified as Haruna Mustapha has been remanded in a custodial centre by a Chief Magistrate court in Kaduna state on Tuesday, October 4, for sod*mizing a nine-year-old boy.
The defendant is facing a charge of an ‘unnatural’ offense.
The prosecutor, Chidi Leo, had told the court that the accused committed the offence on September 28 at his residence in Kinkinau.
He alleged that on the same date, at about 12:30 p. m, the defendant deceived and lured a nine-year-old boy into his living room and had an#l s3x with him several times.
He added that the defendant was caught and handed over to the police when a neighbor heard the boy’s cry in the defendant’s room.
According to the prosecutor, the offense contravened section 257 of the Kaduna State Penal Code, 2020 (as amended).
The magistrate, Ibrahim Emmanuel, who did not take the defendant’s plea, ordered the prosecutor to duplicate the case file and send a copy to the director of public prosecution for legal advice.
He further ordered that the defendant be remanded in prison custody pending receipt of the DPP’s advice.
Mr Emmanuel adjourned the matter until November 2 for a mention.
