Court Acquits Three Persons Accused Of Culpable Homicide

The court discharged them of the offence of criminal conspiracy and culpable homicide.

Three men accused of criminal conspiracy and culpable homicide in Babura Local Government have been acquitted by The Jigawa State High Court sitting in Gumel on Wednesday.

The accused persons, Audu Ibrahim, Ali Baso and Tambai Ali, were charged to court for allegedly killing one Saminu Sani.

They were accused of beating Sani to death while quarreling after they attended a wedding ceremony at Yola Fulani Settlement, Kaya Village in Babura Local Government.

The prosecution counsel presented three witnesses and tendered extrajudicial statements of the defendants in evidence and medical report to prove his case.

Delivering the judgment, Hon. Justice Abubakar Sambo found that none of the offenses of culpable homicide were established against the three defendants by the prosecution counsel.

Justice Sambo, therefore, discharged them of the offense of criminal conspiracy and culpable homicide.

“Because of the existence of contradiction in the evidence of 2nd prosecution witnesses who in the court claim to be eyewitness but in his statement to the police, he said he was informed by one Abdullahi Haruna
,” the judgment read.
